These Terms of Service ("Terms") govern your use of the Level Up mobile application, including its activities, content, and related features (the "App"). The App is provided by The Henry M. Jackson Foundation for the Advancement of Military Medicine, Inc. ("HJF"), "we," "us," or "our".
By downloading, installing, accessing, or using the App, you agree to these Terms and acknowledge our Level Up Privacy Policy. If you do not agree, do not use the App.
1. What the App Is
Level Up is a life-skills app. It offers short activities and learning content you can complete on your own. It is not therapy, medical care, or a way to reach a person.
1.1 Purpose. The App provides self-guided life-skills content, which may include learning modules, videos, tips, exercises, and short questionnaires ("Content"). The App is intended for general educational and self-improvement purposes.
1.2 Research study. The App is offered as part of a research study. The informed consent document you received for the study also applies to you. If the consent document and these Terms conflict, the consent document controls.
1.3 Changes to the App. We may add, change, or remove features or Content at any time, including when a program or study phase ends. We will try to give reasonable notice of changes that significantly affect how you use the App.
2. Not Medical Care, Not for Emergencies
Your study coach may look at your progress. The App is not monitored 24/7. If you are in crisis, use the resources below, not the App.
2.1 No medical or professional advice. The App does not provide medical, mental health, legal, or financial advice, diagnosis, or treatment, and it does not create a clinician–patient relationship. Content is not a substitute for care from a qualified professional. Always seek the advice of a qualified provider with questions about your health.
2.2 Not monitored in real time. Your assigned study coach may review reports of your activity in the App, as described in the Privacy Policy and your consent document. However, information you enter is not monitored in real time, and neither the App nor your coach is an emergency service. Do not use the App or the study email address to request emergency help or report an emergency.
2.3 If you need help now:
- Call or text 988, then press 1 (Military / Veterans Crisis Line), or text 838255, or chat at VeteransCrisisLine.net.
- Call 911 or go to the nearest emergency room if you or someone else is in immediate danger.
- Military OneSource, 800-342-9647, for non-emergency support.
3. Who Can Use the App
You need to be old enough and enrolled in the study.
3.1 Eligibility. You must be at least 18 years old to use the App. Access is limited to individuals enrolled in the study.
3.2 Your account. You will be assigned a study ID and a password to use the App. You are responsible for keeping your login information confidential and for activity under your account. Do not share your credentials or use another person's account. Tell us promptly at life-skills-study-ggg@usuhs.edu if you believe your account has been used without your permission.
4. Your Information and Privacy
The App collects what you enter, basic usage information, and crash reports. It does not collect GPS location, health-sensor, or other background ("passive") data. We don't sell your information or use it for advertising. The Privacy Policy has the details.
4.1 Privacy Policy. Our collection, use, and protection of information through the App is described in the Level Up Privacy Policy and your study consent document. The Privacy Policy is part of these Terms.
4.2 What the App collects. The App collects the information you enter (such as your responses to activities and questionnaires), your assigned study ID, information about how you use the App (such as which features you open, when, and whether activities are completed), basic technical information about your device needed to operate the App, and analytics and crash information collected through Google Firebase and Sentry, as described in the Privacy Policy. The App does not collect passive sensor data, including GPS or location data, step counts, or data from Apple HealthKit or Google Health Connect.
4.3 How it is used. We use this information to operate and support the App, fix problems, keep the App secure, and improve it; to allow your assigned study coach to review your progress; and for the research purposes described in your consent document. We may create aggregated or de-identified statistics that do not identify you.
4.4 No sale or advertising. We do not sell, rent, or trade your information, and we do not use it for marketing or advertising.
4.5 Security. We use reasonable administrative, technical, and physical safeguards to protect your information. No system is perfectly secure, and we cannot guarantee that information will never be accessed without authorization.
4.6 Legal disclosures. We may disclose information if we believe in good faith that disclosure is required by law, regulation, subpoena, or court order, or is necessary to protect the safety of any person.
4.7 Deleting your account. You can stop using the App at any time. To delete your account, email life-skills-study-ggg@usuhs.edu. Information already collected may be kept as described in the Privacy Policy.
5. Acceptable Use
Use the App for its intended purpose, and don't try to break it, misuse it, or access what isn't yours.
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- access, or attempt to access, accounts, data, or systems that you are not authorized to access;
- interfere with, disrupt, or place an unreasonable load on the App or the servers that support it;
- introduce viruses or other harmful code;
- use automated means (such as bots or scrapers) to access the App or its Content;
- enter other people's personal information, or information you are not permitted to share, into the App; or
- copy, redistribute, or commercially exploit the Content except as allowed in Section 6.
6. Ownership and Content
The Level Up name and the Content in the App belong to us or our partners, and you can use them only for your own personal use.
6.1 Open-source components. The App may include open-source software components that are licensed under their own terms. Nothing in these Terms limits any rights you have under those licenses.
6.2 App Content and names. The Content, and the Level Up name, logos, and other marks, are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and Content for your own non-commercial use while these Terms are in effect. All rights not expressly granted are reserved.
6.3 Your responses. You keep whatever rights you have in the information you enter. You give us permission to store and use it as needed to provide the App and as described in the Privacy Policy and your consent document.
6.4 Feedback. If you send us suggestions or feedback about the App, we may use them without restriction or obligation to you.
7. No Endorsement
Using the App doesn't mean the Department of Defense or any government agency endorses it.
The App was developed with funding from the Defense Health Agency. The views, opinions, and Content in the App are those of the authors and do not necessarily reflect the official policy or position of the Department of Defense, the U.S. Government, the Uniformed Services University, or HJF. Mention of any product, service, or organization does not imply endorsement.
8. Third-Party Services and App Stores
Apple and Google distribute the App but aren't responsible for it. We are.
8.1 Third-party services. The App may link to or rely on services we do not control, such as your device's operating system, app stores, or external websites. Your use of those services is governed by their own terms and policies.
8.2 Apple App Store. If you downloaded the App from the Apple App Store: (a) these Terms are between you and us, not Apple, and Apple is not responsible for the App or its Content; (b) Apple has no obligation to provide maintenance or support for the App; (c) to the extent any warranty applies, Apple has no warranty obligation with respect to the App, and any claims, losses, or costs attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed; (d) we, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims; (e) we, not Apple, are responsible for the investigation, defense, and settlement of any claim that the App infringes a third party's intellectual property rights; (f) you represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties; (g) you must comply with applicable third-party terms when using the App; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimers
We work to keep the App running and accurate, but we can't promise it will always be available, error-free, or right for your situation.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
10. Limitation of Liability
The App is provided free of charge, and our liability to you is limited as described below, to the extent the law allows.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, TRUSTEES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
11. Ending Your Use
You can stop using the App at any time. We may end access when a program ends or if the Terms are violated.
11.1 By you. You may stop using the App and delete your account at any time (see Section 4.7).
11.2 By us. We may suspend or end your access to the App at any time, including if you violate these Terms, if needed to protect the App or other users, or when the program or study through which you received access ends.
11.3 Survival. Sections 2, 4.6, 6, 7, 9, 10, 12, and 13 continue to apply after your access ends.
12. Changes to These Terms
If we change these Terms, we'll post the new version here and tell you in the App if the change is significant.
We may update these Terms from time to time. The current version will always be posted at this page with the "Last updated" date. If we make a material change, we will provide notice through the App or by other reasonable means before the change takes effect. Your continued use of the App after the updated Terms take effect means you accept them. If you do not agree, stop using the App.
13. General
13.1 Governing law. These Terms are governed by applicable U.S. federal law and the laws of the State of Maryland, without regard to conflict-of-laws rules.
13.2 Entire agreement. These Terms, together with the Privacy Policy and your study consent document, are the entire agreement between you and us about the App.
13.3 Severability. If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary, and the rest will remain in effect.
13.4 No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
13.5 Assignment. You may not transfer your rights under these Terms. We may assign these Terms to an affiliate or to a successor organization responsible for the App.
